Pennybacker's Herbarium

This collection contains 26 botany samples and information compiled by Julian Pennybacker, a student at the Agricultural and Mechanical College of Texas. The herbarium was a class project for a Texas A&M College botany class project in 1881 and the samples were collected in the Brazos Valley.

In November 2003, the herbarium was examined by M. D. Reed of the Texas A&M University Biology Department. She made the following note which is attached to the herbarium:

This was a student collection made for a botany class. Pennybacker appears on student rolls of the era.
The book used to identify the plants was probably something by Asa Gray and not meant to cover Texas. Since there was no complete treatment of the Texas flora at the time, this cannot be considered a fault.
When examined in 2003, the specimens were found to be fragmentary, mixed together, and separated from their sheets. To the extent possible, they were identified, remounted, and databased by Monique Dubrule Reed of the Biology Department Herbarium.

Percy Ives' Walt Whitman Sketch

Original pencil sketch made in 1881 when Percy Ives, then an art student at the Pennsylvania Academy of Fine Arts, visited Whitman at his home in Camden, New Jersey.
In 1915 Ives presented the drawing to Powys when the novelist traveled to Detroit, Ives' home town, to begin a series of lectures. Powys subsequently gave the drawing to his sister Philippa, probably after she had visitied Whitman's home in Camden in 1923-1924.

The drawing is signed by both Ives and Whitman. Reframed in 2012 displaying all inscriptions.

This collection includes several letters from Gathright, who was the first president of the Agricultural and Mechanical College of Texas (now Texas A&M University), to several different correspondents during his Presidency. Although the writing is not very clear, most of the letters are written to Judge Louis McInnis and the Governor of Mississippi during that time. Some of the letters were transcribed in Early History of Texas A&M College Through Letters and Papers (1952), by David Brooks Cofer.

John B. Zimmerman Papers

This collection includes a ledger and a diary from John B. Zimmerman. The ledger contains mostly handwritten speeches and essays by John, also found within the ledger are notations of "flour received from Dailley & Co." for May to July 1867, two commencement programs attached in the back for Sam Houston Normal Institute (1880) and the University of Nashville State Normal College (1883), both where John graduated from. The diary was written later during the year 1891, though the physical diary itself was meant for the year 1890. Notes concerning this can be seen on the inside of the front cover, as well as the following notation, "Diary E - For abbreviations and explanations, see diaries B & C". However, there are no other diaries included in this collection.

This collection consists of a group of thirty issues of The Argonaut (1879-1889) containing twenty-three science-fiction stories by Robert Duncan Milne, some in two or three parts. References to "Moskowitz" indicate his edition of eleven stories by Milne, Into the Sun (West Kingston, RI: Donald M. Grant, Publisher, 1980). Eighteen of the stories in this lot were not published in Moskowitz's edition and have never been reprinted, to the best of our knowledge.

The time period covered in this lot is 1879 to 1889. The Argonaut was generally printed on good, non-pulpy paper and, barring abuse, remains in good condition and can be handled with due care without fear of crumbling paper. The Argonaut was a weekly literary newspaper published in San Francisco starting in 1878 and running well into the 20th century. It contained political commentary as well as departmental reviews of books, drama, food, fashion, etc. Ambrose Bierce wrote weekly columns during the first two and a half years of its existence. The editors had a penchant for weird and fantastic fiction and published such material by W. C. Morrow, Emma Frances Dawson, Robert Duncan Milne and a host of other minor authors, as well as offering translations of European material in this vein. Milne was evidently popular among The Argonaut readers, for his stories are often featured on the front page.

  • This is a problematic set of papers. They are mimeographed (20th century) copies of documents that chronicle the unfortunate events leading to Burns never receiving his supposed appointment to Major General and his resulting decision to resign. Additionally, there is a footnote written by possibly him but in the third person. There is a typed "copy" (Undated) that was alleged to have been written by Sedgwick recommending the appointment.

  • D - Letter (apparently) from Burns to a [Fry?]. Rather tersely written letter of inquiry to someone who was, it seems, an intermediary in the non-appointment dealings-possibly James Barnet Fry. Handwritten letter, no signature. 1 leaf, ca. 1863.

This collection consists of 26 plant sample sheets (not all containing plants) with descriptions that had been collected from the area surrounding the Texas A&M campus in Brazos Valley County. The samples were gathered from April 14 to May 28, 1890, by Eugene W. Carter.

In November 2003, M. D. Reed of the Texas A&M University Biology Department repaired and curated the herbarium's botany samples leaving the following note: This collection may have been used as a teaching aid in a Botany class, since E. W. Carter does not appear in student rolls from the period.
These are common plants of the Brazos Co. spring flora. The "analysis" on each sheet is correct and painstakingly thorough. The book used to identify the plants was probably one by Asa Gray not meant for Texas. But since there was no complete treatment for Texas in 1890, this is hardly a fault.

The financial documents include a bill of sale written in compliance with the Maverick Law of 1884 and a promissory note. The legal documents were produced in connection with the criminal proceedings against the participants of the range war.

TT - Letter from J. B. Allen to Mrs. Burns. Letter refers to "your late husband, Genl W. W. Burns" and expresses appreciation to her having sent copies of his papers to be read at a meeting of the Brigade Association. Handwritten, 1 leaf, 2 pages, 15 May 1893.

UU - Letter (very difficult to read) with an illegible signature to [Sen?]. This letter seems to refer to an election. Handwritten, 1 leaf, 2 pages, 1 November [year?].

It describes "Mexican Pensions" and makes several comments that indicate that he thought U. S. Military Academy graduates had been bypassed or discriminated against. XX - Notes by Burns. It is unclear what this is but it is in Burns' handwriting. It may be a transcription of something he saw but it regards a Broadway playwright named E. A. Sothern and a Chicago lawyer who wrote him a letter. It is in verse. Handwritten, 1 sheet, 2 leaves, 3 pages, Undated.

Foreman's Bill of Sale, July 3, 1884 (1 leaf)
This bill of sale was signed by Lee Moore and is the first recorded use of the requirements of the Maverick Law of 1884. Lee Moore would go on to be known as the "king of the rustlers" and was marked for execution by the Wyoming Stock Growers Association during the Johnson County War.

Promissory Note, July 16, 1888 (1 leaf)
This note, signed by A.S. Mercer in favor of the St. Louis Type Foundry, was one of six notes in the amount of $274.35. In October 1892, Mercer's paper, the Northwestern Live Stock Journal, published George Dunning's "Confession." In response, the Wyoming Stock Growers Association used the charge of non-payment of the four-year-old disputed notes to shut down operations and confiscate copies of the paper. Mercer had already paid two of the notes before the dispute took place.

Letter from A.S. Mercer to Thomas B. Adams, February 25, 1890 (1 leaf). Written on the letterhead of his paper, the Northwestern Live Stock Journal, Mercer questions the date chosen for the spring meeting of the Wyoming Stock Growers Association. He points out that the date called for in the Maverick Law differs from the date stated by Adams and Glover.

Glenrock Resolution, May 3, 1892 (3 leaves)
This handwritten resolution of the citizens of Glenrock County, Wyoming, expresses their outrage over the events of the Johnson County War. The resolution also criticizes acting governor Amos W. Barber for his failure to stop the invasion and calls for the free use of the open range. Over sixty Glenrock county residents attended the mass meeting, which produced this resolution. A.J. Seymour and George Devoe, chairman and secretary of the meeting respectively, signed the resolution.

State of Wyoming v. Alexander Adamson, et al. Murder in the First Degree, June 6, 1892 (4 leaves)
This information was filed in Johnson County, charging four men, Alexander Adamson (manager of the Ferguson Land and Cattle Company), William E. Guthrie (partner in the Guthrie and Oskamp Cattle Company), and William Armstrong and J.A. Garrett (both Texas gunfighters) with the murder of Rueben "Nick" Ray during the invasion of Johnson County. Ray was Nate Champion's partner at the siege of the K.C. ranch. Similar Information was filed in the name of Champion. This document was filed in Johnson County before the cattlemen were remanded to Laramie County, which was thought to be more sympathetic to their cause.

Criminal Libel, State of Wyoming vs. Emerson H. Kimball, November 11, 1892 (3 leaves)
Arthur B. Clarke, one of the invaders of Johnson County, filed this Charge of Criminal Libel against Douglas Graphic editor Emerson Kimball. The two-page information charges that Kimball alleged Clarke was one of the murderers who lynched Thomas Waggoner, a killing that preceded the beginning of the Johnson County War.

Motion to Dismiss, State of Wyoming vs. Frank M. Canton, et al., January 21, 1893 (2 leaves)
The trial was eventually set for January 1893 in Cheyenne, but it proved extremely difficult to find enough men to serve on the jury. Eventually, the disappearance of the two trappers who had witnessed the killing of Champion and Ray and the high financial cost of the trial to Johnson County led to the filing for dismissal of the case.
